Abstract

Public lnterest Litigation (PIL) has emerged as an important tool for judicial activism and social justice in many countries around the world. This research paper examines the role of the judiciary in providing justice through PIL, with a focus on its significance, evolution, and impact. The paper explores the historical background of PIL, its conceptual framework, and its evolution as a means to protect the rights of the marginalized and vulnerable sections of society. It also discusses the various types of PIL and their scope and provides examples of landmark cases that have shaped the jurisprudence of PIL. The paper analyzes the contribution of the judiciary in promoting PIL and ensuring access to justice, while also highlighting the challenges and criticisms associated with PIL. The paper concludes by emphasizing the importance of an independent and proactive judiciary in upholding justice through PIL and suggests recommendations for strengthening the role of the judiciary in providing justice to the society at large.
